Worker’s compensation lawyer helping Roanoke and Salem residents to gain replacement of their lost wages

Virginia is like most other states in that employers are required to carry worker’s compensation insurance. Virginia companies must carry such insurance if they employ two or more people. An employee’s workplace injury will be covered if it occurred at work while the employee was engaging in an employment-specific activity and that activity caused the accident. Also, the injury generally must happen suddenly and must not have been caused by the employee’s own misconduct. Accidents caused by employee’s negligence or “repetitive stress” often are not subject to coverage. If an employee’s injury qualifies for coverage, then they may receive up to two-thirds of their average weekly wages for a period of up to five hundred weeks. A victim may receive longer-term payments if they have been permanently disabled by a workplace injury.

The first step in recovering one’s lost wages is to notify the employer, in writing, of the accident. A notice must be provided within thirty days of the time at which the accident occurred. The employer will file a “First Injury Report” within ten days of the time that they receive notice of the accident. Virginia’s Worker’s Compensation Commission will then send the worker a notice of their rights under the claims process. The worker may then file a claim with the Commission for benefits. The process of filing a worker’s comp claim may seem straightforward but it can become complicated quite quickly. It is best to retain an attorney to assist you.

Many claimants (injured worker) quickly become confused on who is involved in the process and generally refer to anybody they talk to as “workers comp”. To clarify, there is the Workers Compensation Commission which is the like the Court, but a little more interactive than most courts. Then you have the defendant which is the company who will have an insurance company or a defense attorney that tries to talk to you. Most often injured workers do not realize they are talking to someone that does not have their best interest in mind. Whatever an injured worker says to the defense will more than likely be used against the worker, if and when possible. It is best to hire an attorney and tell the opposing side “talk to my lawyer” or, alternatively, refuse to talk to them. You never need to talk to anyone you do not want to talk to.
